In Skrmetti, they said it wasn't discrimination on the basis of sex because it applied to both trans girls and trans boys. Now that the sports ban only applies to trans girls, it's not discrimination on the basis of trans status.

I think it’s important to insist on recalling, at all available opportunities, that this was specifically an attack on a trans instructor over an assignment about gender. Neither of those details are incidental; they are the center of the story

This was entirely about purging a trans instructor from the school and they succeeded. It was aided by a lot of dumb liberals taking it at face value arguing the minutia of grading rubrics while ignoring the obvious bad faith efforts behind this.
