a) No reguirement of exclusive in.tent 47. In Brazil's view, it does not follow therefrom that the existence of additional goals, such as military ones, would automatically exclude genocidal intent as the "only reasonable inference" which can be drawn from a pattern of conduct. 48. Such an interpretation would fail to recognize that human beings - and States alike - often have more than one motive or objective for their conduct. By setting an excessively restrictive standard of proof, it would also be incompatible with the principle ut res magis valeat quam pereat, and would deprive the Convention of its appropriate effects (effet utile).

URGENT Joint Statement from 60 Civil Society and Activist Groups/Organizations across the Asia Region on the Thai-Cambodian Conflict 26 July 2025 Joint Statement from Civil Society and Activist Organizations across the Asia Region on the Thai Cambodian Conflict The armed conflict situation in the Thai Cambodian border area, ongoing since July 24, 2025, has caused severe damage and created a humanitarian crisis. As of July 26, 2025, initial reports indicate at least 30 confirmed deaths, including children, with unconfirmed casualties potentially higher. Additionally, there are numerous injured individuals, and over one hundred thousand people have been forced to urgently evacuate the conflict zone. The use of armed force has directly and severely impacted the lives, property, and safety of the people in both countries. Considering the escalating crisis, civil society organizations and activists across the Asia region unite to issue the following urgent demands: 1. Immediate and Unconditional Ceasefire. All parties involved in the conflict must immediately and unconditionally cease all hostilities. The fighting must stop now to prevent further loss of innocent lives, prevent more injuries, and alleviate the immense suffering of civilians caught in the crossfire. This ceasefire is the crucial first step towards any peaceful resolution. 2. Activate Bilateral Negotiation Mechanisms and Engage ASEAN. We call for an immediate return to peaceful dialogue through established bilateral negotiation mechanisms between Thailand and Cambodia. Furthermore, we urge the Association of Southeast Asian Nations (ASEAN) to actively engage and mediate this conflict. ASEAN's rote is vital in facilitating constructive dialogue, de escalating tens‘ons, and supporting a sustainable, diplomatic resolution that respects the sovereignty and well being of both nations. 3. Demand an End to Information Operations that Incite Hatred. We unequivocally demand that all parties cease any actions, including the use of hashtags or trending topics, that promote or incite hatred, radical nationalism, or discrimination against any group. សេចក្តីថ្លែងការណ៍រួមរបស់សង្គមស៊ីវិល និងសកម្មជនក្នុងតំបន់អាស៊ី ស្តីពីជម្លោះកម្ពុជា-ថៃ សេចក្តីថ្លែងការណ៍រួមរបស់សង្គមស៊ីវិល និងសកម្មជនក្នុងតំបន់អាស៊ី ស្តីពីជម្លោះកម្ពុជា-ថៃ ស្ថានភាពជម្លោះប្រដាប់អាវុធនៅតាមតំបន់ព្រំ ដែនកម្ពុជា-ថៃ ដែលកំពុងបន្តកើតមានឡើងតាំងពីថ្ងៃទី២៤ ខែកក្កដា ឆ្នាំ២០២៥ បានបង្កការខូចខាតយ៉ាងធ្ងន់ធ្ងរ និងបង្កើតឲ្យមានវិបត្តិមនុស្សធម៌ យ៉ាងខ្លាំងផងដែរា គិតត្រឹមថ្ងៃទី 26 ខែកក្កដា ឆ្នាំ 2025 របាយការណ៍ដំបូងបង្ហាញពីការស្លាប់បានបញ្ជាក់ថាយ៉ាងហោចណាស់មនុស្ស 30 នាក់ បានស្លាប់ដោយក្នុងនោះក៏មានទាំងកុមារផងដែរ ហើយចំនួនដាក់ស្តែងគឺអាចច្រើនជាងនេះ។ បន្ថែមពីលើនេះទៀត ចំនួនអ្នករងបួសក៏មានចំនួនច្រើន ផងដែរ។ ហើយមនុស្សជាងមួយសែននាក់ត្រូវបានបង្ខំឱ្យភាសខ្លួនជាបន្ទាន់ចេញពីតំបន់ជម្លោះ។ ការប្រើប្រាស់កម្លាំងប្រដាប់អាវុធបានបង្ករផល់ប៉ះ ពាល់ដោយផ្ទាល់ និងធ្ងន់ធ្ងយ៉ាងខ្លាំងដល់អាយុជីវិត ទ្រព្យសម្បត្តិ និងសុវត្ថិភាពពលរដ្ឋស៊ីវិលរបស់ប្រទេសទាំងពីរា ដោយមើលឃើញពីវិបត្តិដ៏ ធ្ងន់ធ្ងរនេះ អង្គការសង្គមស៊ីវិល និងសកម្មជនទូទាំងតំបន់អាស៊ី បានរួមគ្នាចេញនូវការទាមទារបន្ទាន់ដូចខាងក្រោម៖ 1. បទឈប់បាញ់ជាបន្ទាន់ ដោយគ្មានលក្ខខណ្ឌ។ គ្រប់ភាគីពាក់ព័ន្ធក្នុងជម្លោះត្រូវតែបញ្ឈប់ជាបន្ទាន់ និងដោយគ្មានលក្ខខណ្ឌ។ ការ ប្រយុទ្ធគ្នាត្រូវតែបញ្ឈប់ភ្លាមៗ ដើម្បីបង្ការកុំឲ្យមានការបាត់បង់អាយុជីវិត និងរងរបួសរបស់ជនស្លូតត្រង់បន្ថែមទៀត។ ជាមួយគ្នានេះដែរ ក៏ដើម្បីកាត់ ដោយសន្តិវិធីណាមួយៗ បន្ថយការឈឺចាប់ដ៏ធំធេងរបស់ជនស៊ីវិលដែលជាប់នៅក្នុងភ្លើងសង្គ្រាម។ បទឈប់បាញ់នេះគឺជាជំហានដំបូងដ៏សំខាន់ឆ្ពោះទៅរកដំណោះស្រាយ 2. បង្កើតយន្តការចរចាទ្វេភាគីសកម្ម ដោយដាក់បញ្ចូលគណកម្មការសមាគមប្រជាជាតិអាស៊ីអាគ្នេយ៍ (អាស៊ាន)។ យើងអំពាវនាវឱ្យ មានការិលត្រឡប់ទៅកិច្ចចរចាដោយសន្តិវិធីជាបន្ទាន់តាមរយៈយន្តការចរចាទ្វេភាគីដែលបានបង្កើតឡើងរវាងប្រទេសថៃ និងកម្ពុជា។ លើសពីនេះ 1ទៀតយើងជំរុញឱ្យសមាគមប្រជាជាតិអាស៊ីអាគ្នេយ៍ (អាស៊ាន) ចូលរួមយ៉ាងសកម្ម ក្នុងការសម្របសម្រួលជម្លោះនេះផងដែរ។ តួនាទីរបស់អាស៊ា នមានសារៈសំខាន់យ៉ាងខ្លាំងក្នុងការសម្របសម្រួលកិច្ចសន្ទនាដែលមានលក្ខណៈ ស្ថាបនា ប្រកបដោយស្មារតីកាត់បន្ថយភាពតានតឹង និងគាំទ្រ ដំណោះស្រាយការទូតប្រកបដោយនិរន្តរភាព ដែលគោរពអធិបតេយ្យភាព និងសុខុមាលភាពរបស់ប្រទេសទាំងពីរ។ 3. ទាមទារឱ្យបញ្ចប់ប្រតិបត្តិការព័ត៌មានដែលមានលក្ខណះញុះញង់ឱ្យមានកាស្អប់ខ្ពើម។ យើង แถลงการณ์ร่วมจากภาคประชาสังคมและกลุ่มนักกิจกรรมในภูมิภาคเอเชีย ต่อสถานการณ์ความขัดแย้งบริเวณชายแดนไทย-กัมพูชา สถานการณ์ความขัดแย้งทางอาวุธในพื้นที่ชายแดนไทย-กัมพูชา ซึ่งดำเนินมาอย่างต่อเนื่องตั้งแต่วันที่ 24 กรกฎาคม 2568 ได้ก่อให้เกิดความเสียหายและนำไปสู่วิกฤตด้านมนุษยธรรม ข้อมูลในวันที่ 26 กรกฎาคม 2568 มีรายงานว่ามีผู้เสียชีวิตอย่าง น้อย 30 ราย รวมถึงเด็ก มีผู้บาดเจ็บอีกจำนวนมาก และคาดว่าตัวเลขผู้บาดเจ็บและเสียชีวิตอาจมีมากกว่าที่รายงาน นอกจากนี้ ประชาชนกว่า 100,000 คนต้องอพยพออกจากพื้นที่อย่างเร่งด่วน การใช้กำลังอาวุธในครั้งนี้ส่งผลกระทบอย่างรุนแรงและโดยตรง ต่อชีวิต ทรัพย์สิน สัตว์ สิ่งแวดล้อม และความปลอดภัยของประชาชนทั้งในฝั่งไทยและกัมพูชา ท่ามกลางวิกฤตที่ทวีความรุนแรงขึ้น องค์กรภาคประชาสังคมและนักเคลื่อนไหวจากทั่วภูมิภาคเอเชีย ร่วมกันออกข้อเรียกร้องเร่งด่วนดังต่อไปนี้ 1. หยุดยิงทันทีและโดยไม่มีเงื่อนไข ทุกฝ่ายที่เกี่ยวข้องในความขัดแย้งจะต้องยุติการใช้ความรุนแรงและการสู้รบทั้งหมด ในทันทีและโดยปราศจากเงื่อนไขโต ๆ การหยุดยิงจำเป็นต้องเกิดขึ้นเพื่อหยุดยั้งการสูญเสีย ป้องกันไม่ให้เกิดผู้บาดเจ็บเพิ่มเติม และบรรเทาทุกข์ของพลเรือนที่ตกอยู่ท่ามกลางความขัดแย้ง 2. เปิดกลไกการเจรจาทวิภาคี และให้อาเซียนเข้ามามีบทบาท เราเรียกร้องให้มีการกลับสู่โต๊ะเจรจาอย่างสันติโดย เร่งด่วน ผ่านกลไกการเจรจาทวิภาคีระหว่างประเทศไทยและกัมพูชา และให้สมาคมประชาชาติแห่งเอเชียตะวันออกเฉียงได้ (อาเซียน) เข้ามามีบทบาทในการไกล่เกลี่ยความขัดแย้ง บทบาทของอาเซียนมีความสำคัญในการอำนวยความสะดวกในการเจรจา ลดความตึงเครียด และสนับสนุนแนวทางการแก้ไขปัญหาทางการทูตที่ยั่งยืน ซึ่งเคารพต่ออธิปไตยของทั้งสองประเทศ 3. ยุติปฏิบัติการข้อมูลที่ปลุกปั่นความเกลียดชัง เราเรียกร้องให้ทุกฝ่ายยุติการกระทำใด ๆ ที่ส่งเสริมหรือปลุกปั่นความ เกลียดชัง ไม่ว่าจะเป็นการใช้แฮชแท็ก กระแสบนสื่อสังคมออนไลน์ หรือการสื่อสารรูปแบบอื่น ๆ ที่เผยแพร่แนวคิดชาตินิยมแบบ สุดโต่ง หรือนำไปสู่การเลือกปฏิบัติต่อกลุ่มใดกลุ่มหนึ่งโดยเฉพาะ กิจกรรมเหล่านี้จะยิ่งเพิ่มความตึงเครียด บ่อนทำลายสันติภาพ ภายใน และอาจนำไปสู่ความรุนแรงที่มีเป้าหมายต่อผู้คนภายในประเทศ ถือเป็นการละเมิดสิทธิมนุษยชนอย่างชัดเจน กองกำลังติด อาวุธของทุกฝ่ายต้องปฏิบัติตามหลักกฎหมายมน
