1. Yes, Trump launching a new military operation overseas without Congress’ prior declaration of war or authorization of force is almost certainly unlawful.
2. No, there is no real chance the courts will stop it.
Unfortunately our Constitution means little when the judiciary won’t enforce it.

Under the UN Charter, use of force against another state is illegal absent self-defense or Security Council authorization. Bombing a sovereign country & forcibly removing its head of state meets the legal definition of war. With No UN approval & no congressional authorization. He must be removed!

Whatever you might think of Maduro, the seizure and kidnapping of a head of state takes us to a very dark place. Vast, arbitrary, extra-legal power, which could be exercised almost anywhere, regardless of the character of the target government.
