As we watch counterterrorism infrastructure be used to silence dissent and terrorize marginalized people, I want to re-up some of my analysis on how the law makes this possible and must be changed 👇
I'm not seeing enough media covering how potentially big of a deal this is.

In 2010, the Supreme Court upheld as constitutional the federal crime of "material support for terrorism." That probably sounds fair enough - but the details matter. 🧵👇
Under a 2010 ruling from the Supreme Court, domestic groups can face “material support” charges for providing nonviolent support to designated foreign terrorist organizations. interc.pt/4i1EqYJ

Really significant development.

His "domestic terror designation" of "antifa" didn't mean anything legally. An actual foreign terror designation means quite a lot.

Many thanks to KSQD for having me on to talk about the Trump admin's inappropriate application of war authorities to bomb dozens of people in the Caribbean, deport people without due process, and chill free speech.

Meet Yaa’kub Ira Vijandre. He’s the US’ latest political prisoner.

His detention is designed to send the message that anything noncitizens post in support of disfavored causes can be labeled a deportable threat to national security.

Terrifying reporting from @attackerman.bsky.social: a DACA recipient is in removal proceedings entirely because of pro-Palestine Instagram posts (which is perfectly legal under current counterterrorism law, as I've written about!) www.forever-wars.com/ice-caged-th...

So, in the very most optimistic best-case scenario made possible by this "deal," millions of people suffered so the Senate can vote down an extension of the subsidies and the House can ignore it completely?
November 11, 2025 at 3:00 AM
wow so crazy there are EXACTLY enough Dems to push the deal through and NONE of them are up for re-election! what are the odds!!11!!!
November 10, 2025 at 4:32 AM
Substitute "health care" "affordability," anything else for "democracy" here, it's all true. The sooner the broader progressive establishment understands all these struggles are connected, the sooner things change. Not until then.

There will be some "Wow you can't make these people happy" sentiment but what's really happening is the Dems are beginning to reap the consequences of not really believing in anything. Choreographed maneuvers, too clever by half talking points. People have just had it

Truly funny in hindsight that Chuck Schumer of all people tried to make "TACO Trump" a thing.

There is very little in this life that you can count on with 100% reliability. But, one of those things is that Democratic leadership will fulfill their role as controlled "opposition," every single time.

As @ahjohnson.bsky.social points out here, the US media is stroking its chin & pondering why Trump wants to attack Venezuela. They somehow overlook his stated motivation, which is that Venezuela has the world's biggest oil reserves.

This has been US policy for nearly 25 years.
Trump: "I don't think we're necessarily going to ask for a declaration of war, I think we're just gonna kill people that are bringing drugs into our country. We're going to kill them. They're going to be, like dead."

Terrific writeup from @nickturse.bsky.social as always.

@bcfinucane.bsky.social's point is undoubtedly correct. Yet the admin has already stated its (wrong) position that there IS an armed conflict.

So what will Congress+ courts do about it? Their post-9/11 complacency just became more dangerous.
“Given that there is no armed conflict, there is no basis to hold these survivors as law of war detainees,” @bcfinucane.bsky.social, a former State Department lawyer who is a specialist in counterterrorism issues and the laws of war, told @theintercept.com
October 17, 2025 at 10:21 PM
This is why I said it was so dangerous when the Trump admin stated the US is in an armed conflict with cartels. It's not just the military strikes - they are likely now going to claim the power to indefinitely detain people they decide are associated with cartels.
