Freedoms and rights that the government can choose to take away whenever they want aren’t rights.

Good gravy, it’s not that hard to understand. But some people seem to think the amendments in the Bill of Rights includes “unless you are a bad person” at the end of each of them.

My kiddo is in middle school, and they are studying the Bill of Rights and the Constitution. It is _really_ difficult to talk about how important the 4th amendment (warrants required) is, when the government is gleefully ignoring it.

There's a strange pattern that shows up in tort law in the 19thC where the court finds really strained reasons for not finding a railroad liable for anything. When I added this as an unwritten factor a lot of tort cases made more sense.

It’s what happens when an industry is immunized from liability for a few decades. The very idea that they could have any responsibility for harms their products cause is incomprehensible to them. A concept that seems entirely insane to them.
