Legal folks, does anyone have any recommended training or notes on doing live cross-examination of a witness that you are hearing testimony for the first time?
I've had two TRO hearings this year where I was opposing, and I had to cross a witness who gave long testimony.

Are there any law professors doing any scholarship on AI search, hallucinations, and defamation or brand tarnishing?
Had a really funky thing happen to a client that leads down some weird places.
Any thoughts @jmiers230.bsky.social or @lexlanham.bsky.social ?

Cash bail should be banned. Someone's ability to be released from jail should not depend on their resources. It should be based upon their continued threat to society and what mitigation efforts the state can use to manage that threat.
The "tough on crime" types want us to think that cashless bail means ppl charged with murder walk.
Two things:
1. Even in the most liberal of places, like NYS, they don't.
2. Don't forget: charged does NOT mean GUILTY. We make mistakes--and those wrongly detained get NOTHING.

Was taking pictures of my kids in front of an old hearth during Christmastime at the Grand Hotel in Point Clear, AL and a nice woman asked if we wanted to get in the picture and she would take it.
After she took our family photo and we were walking away, I realized it was Jennifer Gardner.

My research assistants were each assigned a set of years to find ones they thought would be nice to color. They sent me ~2500. I reviewed & selected 227 from those based on whether I liked the picture well as their description & claim language and not duplicating others that were selected.

I don’t think my client believed me when I told him I had fun arguing a 4 hour TRO hearing in Federal Court today.

I am generally very critical of BigLaw because I think they are usually overpriced and not worth the money.
However, I have had the pleasure of using WilmerHale's IP group in litigation matters, and I cannot overstate how much they impressed me. Are they cheap? No. Are they worth it? Absolutely.

This is how it's done.
A strong and principled response by WilmerHale to the illegal Executive Order attack - a form of attempted government intimidation declared unconstitutional by a federal judge.
This is how to guard the rule of law.

So Trump and Musk are just mindfully dismantling everything as a vendetta for what they deem a problem or "crime" against them. Nothing is really about making America a better place, it's all just a "get back" scheme for their hurt feelings.

Dumb question for patent friends on here:
What is the best format you have seen someone put out claim charts in? I have done claim charts in Word, XLS, and PPT, and I have always waffled about what format looks best.
This is for internal viewing, not production to Court.

This insight should be shared far and wide for people to internalize.
I was enough of a little shit as a teenager that I’m baffled by anyone who views “acknowledging the past iteration of them sucked” as an affront.

Hear me out —
If parents call colleges freaked about their FAFSA data being leaked, schools may have to issue statements — which would reach a whole lot more families about how warped this is.
Organizing isn’t always calling electeds. Sometimes it’s just calling people with a bigger megaphone.

Quick question completely unrelated to chaos going on.
Have IP practitioners found value in being a member of AIPLA? I am not located somewhere that AIPLA would ever meet, so any in-person meetings would require travel. I have easy access to quality CLE (but generally not IP related).

The “black box” theory of AI has also permeated the patent field where examiners across the world have allowed AI claims without requiring disclosures of how the AI is enabled to do what is claimed. Allowing “black box” claiming violates the patent bargain.
Increasingly, we're seeing the "black box" theory become a substitute for investigating under the hood of AI. Doing so completely overlooks the extent of intentional human decision-making that goes into developing these AI driven algorithms.
