“Freedom of speech” is not synonymous with, and not limited to, the First Amendment. Freedom of speech is a value we can all choose to uphold in our workplaces, schools and social circles. It is in tension with other values, such as safety and decency. The government has no choice. We do.
Decisions by Katsas and Rao are not legitimate. If they can’t convince someone else to come along, they’re not making good enough arguments. If the D.C. Circuit wants to be considered legitimate, it needs to stop empaneling these two together and make them work.

We should stop referring to “franchises” or “IP” and instead call them “stories” or “worlds.” Don’t adopt business terms. Keep it about storytellers and audiences.
