NYT video review confirms this. Pretti had a 2nd Am right to carry a firearm. But even if he didn’t he wasn’t pointing it at anyone or threatening agents. There is no legal justification for the execution-style shooting & no basis for DHS’s claim he was there to massacre them. He was a helper.
Brandishing is a legal term that means to display all or part of a firearm, or otherwise make its presence known to another person to intimidate them, regardless of whether it's directly visible to that person. Given the video, that's not what Alex Pretti was doing when he was shot & killed.
Important context, this is the victim’s behavior BEFORE being tackled

US citizen. Public servant. Licensed to carry a firearm but had no weapon in hand when killed. Attacked by ICE agents with chemical munitions for no reason, then shot.

The time for talking is over. If you are an elected leader you have to tell us *now* what you are doing to end this nightmare ASAP.

NEW: Another declaration you have to read! Alex Pretti was shot near the apartment of a doctor, who saw the shooting occur and rushed to provide emergency aid as he lay dying on the street.

They describe what they saw: "The victim had at least three bullet holes in his back."
