I listened to and wrote about the US Supreme Court’s oral argument on the birthright citizenship case yesterday.

It was a wild ride.

Yesterday, SCOTUS heard argument in the 'birthright citizenship' case.

Instead of ruling on the policy's constitutionality, the Court must decide on the permissibility of nation-wide injunctions.

Instead of finishing my damn dissertation, I wrote about the CJEU's decision to outlaw Malta's citizenship for investment scheme.

TLDR: The Court's conception of citizenship is more defensible than the legal reasoning it provided to reach what is an ethically desirable result.
In striking down Malta’s citizenship for investment scheme, the CJEU cast EU citizenship as a “relationship of solidarity and good faith.”

ANJA BOSSOW maps the perils and potential promise of the Court’s embrace of such a thick-ish conception of citizenship.

Deporting your own citizens is plainly illegal.

But it is a logical step for a government that views its own citizens as enemies and is thus willing to trade their security and life for its own populist ends.
The Knesset recently empowered the Minister of the Interior to deport citizens who are family members of terrorists to Gaza.

I’m so excited to have (finally) brought this Symposium to fruition! Stay tuned this week for a series of incisive and inspiring essays from leading scholars working on this question!
2023 saw an acceleration in restrictionist and human rights denying approaches to border control.

Our new Symposium "Rethinking the Law and Politics of Migration" explores how to resist this trend.

@anjabossow.bsky.social on the urgency of this inquiry:

@verfassungsblog.de graciously let me offer some thoughts in this week’s Editorial on what the UK’s obsession with the Rwanda policy, Trump’s inhumane immigration agenda and Scholz’s desire to ‘deport in grand style’ might all have in common.
