Back at work today, and full of thoughts about the Supreme Court judgment last week. It’s much more nuanced than it might seem at first glance, and it’s hard to cut through the vitriol around it. That’s understandable - it’s obviously very emotive. I’m going to try break down the legal principles.

The UKIPO is consulting on their approach to TDM for GenAI - www.gov.uk/government/c....
The consultation is open until 25th Feb, and has many qs - primarily, though, they're asking if it's alright to have an opt-out exception for TDM for commercial purposes, as this is their preferred approach.

Use cases for why we need to actually consider the underlying rightsholder instead of just blindly trusting that the website operator can be trusted to implement safeguards.
This is a good example of why generative AI opt-outs don’t work: this is my music, but I have no way of opting it out of AI training.
