Did you notice how several of the ICJ erga omnes arguments today were similar but taken one step further by the IACtHR? As Judge Tladi highlighted, perhaps considering them jus cogens would have made good sense? Also because they used art. 48 ARSIWA commonly associated with jus cogens violations.
Among the major surprises of the IACtHR's Advisory Opinion on the climate emergency are its reflections on jus cogens and the climate crisis. 🌍⚖️

Such an important Declaration by ICJ Judge Tladi: While declaring the erga omnes character of the climate obligation, it should have perhaps expressed an opinion on the jus cogens character. Powerful declaration.

MY REFLECTIONS: The @CIJ_ICJ advisory opinion marks a profound legal affirmation that climate obligations are not aspirational, they are mandatory. Yet, my relief is tempered by concern: will States heed this mandate or treat it as another well-worded academic text with no teeth.

The ICJ decides developed countries have a legally binding obligation to help developing countries to adapt to climate change ('shall'). The duty of cooperation is an obligation of conduct and can be violated. go.icj-cij.org/40whDN1
