To be clear, I think this ruling was wrong and boneheaded for all the reasons noted in the dissent. But until Congress or the States fix the SCOTUS problem, we have to pretend that its rules matter.

I’m a lawyer. Those are distinctions with a clear difference.

It *may* be true that the difference may not matter for the plaintiffs who filed the case because it’s now too late to do anything about it, but going forward, attorneys will know not to abandon habeas claims after filing.

Basically.

An old standby of SCOTUS is if it can’t justify what it wants to do on merits, it justifies it via procedure.
