This and the last sentence of 3288 which you partially quoted earlier which is basically that you cannot refile an indictment if the problem was no indictment was filed or a reason that would bar prosecution. I would hope that an illegal appt would satisfy both parts.

I think they know they've already written the epitaph on the 9 member court and dems will add 4 justices ASAP so I doubt they'll care.

Lemme guess. SCOTUS decides its too close to the election to force Texas to use old maps, though the timing is 100% Texas's fault. But will then turn around and say that its not to close for California.

This is such BS. Her cop out is "Well they never named the State Department in the lawsuit." because he was never held by State! They never knew he was going to be illegally moved to another country FFS! She needs to be added to the impeachment list.

It does pretty much give carte blanche to the next administration to completely clean house. Whether that will be for the betterment of the country, stay tuned.

Assuming alot of Trumps cabinet get pardons, it will be interesting to see if a dem president goes through the courts to recall those pardons. If its given by the office of the president so should it be taken back.
