The league needs to figure out very quickly how big is "big enough" and come up with a final number, so that it does not become as dysfunctionally crowded as MLS.

One can support males who want to cosplay femininity without compromising female-only spaces.

If a single woman says "no" to a male in her single-sex spaces, will the UUA tell her that her consent does not matter?

No one can consent for another, and no decent person would violate female consent.

The fastest way out I see for Berman is a quiet deal among owners to (a) spread the cost of (b) not renewing current 5ARD male players' contracts, (c) distributed among all teams for the next several years.

Waiting on the IOC or FIFA to solve this for NWSL via CONCACAF would take longer.
November 12, 2025 at 5:11 PM
Is Berman hoping she can bluff this out long enough for these males to cycle out of their current contracts?

Is she hoping that IOC or FIFA will institute global sex-verification to save her these dangers?

The league has dug itself a huge hole here, a grave?

When something doesn't make sense it often makes someone money, so "follow the money."

How many of the owners were privy to discussions before the 2021 NWSL Policy on Transgender Athletes?

How many of the players? The Players Association?

There are potentially huge legal liabilities here.

Banda is the third, suspected 5ARD male signed in March, www.espn.com/soccer/story....

What other owners were expecting this influx of 5ARD players?

How many even understood this was a possibility?

How many were consulted about the 2021 policy?

How did this accord or violate NWSL contracts?

Kundananji is the second suspected 5-ARD male signed by expansion side Bay FC in February, for a record transfer fee.

Which teams or owners were in on the flurry of 5ARD signings at the beginning of 2024?

If all owners were not made aware, what internal agreements did that violate?

Given the huge transfer fees involved, this is financially significant, especially if there were unrecorded, backroom deals.
November 12, 2025 at 3:06 PM
Who quietly decided to rescind the policy without comment, just before Berman came on as commissioner in 2022?

Was deprecation of the policy a condition of Berman taking the commissioner's job?

Did she understand its dangerous stupidity, and what did she do to manage or contain it?
November 12, 2025 at 3:04 PM
Once the policy was created, how did it affect or acknowledge or comply with the Players Association's collective bargaining agreement?

How many lawsuits did this open the league up to, both from displaced players and the NWPA?

What was the NWPA's transparency with its members?

Whose bright idea was it to create the 2021 NWSL Policy on Transgender Athletes and how did it happen to include such an obvious loophole that made signing 5ARD male athletes possible?

In the last few years it has been reinstated by World Rugby, World Aquatics, World Athletics and World Boxing.

The IOC may also be returning it, as per The Times earlier today at www.thetimes.com/sport/olympi....

FIFA needs to clean this up globally and let CAF catch up with the reality that 5ARD "intersex" males are still male and should not be allowed in female sport.

Africa needs to catch up with the science which was not clear when Caster Semenya first stepped onto the world stage: 5ARD male = MALE.
November 10, 2025 at 5:54 PM
Is the league punting on this because they have opened themselves up to lawsuits from female players AND the 5ARD males that they have already allowed in?

www.seattletimes.com/sports/reign...

Do they plan to punt if sued before then, by claiming they did not understand?
