If we had a textualist, originalist, constitutional conservative or strict constructionist Supreme Court, the Equal Rights Amendment is now the validly ratified 28th Amendment to the United States Constitution. We don't, though, so it probably isn't.

The ABC News settlement makes zero sense from a legal standpoint. It assumes there is a moral or reputational difference between forcibly penetrating a woman’s vagina with fingers and doing so with a penis. It also assumes that Trump has a reputation that could suffer damage.
