Just for perspective, close to $300 billion in federal funds (k-12 & higher ed) are on the line. That's not as much as the conditional funding for Medicaid expansion SCOTUS deemed coercive in NFIB v. Sebelius but still substantial (for some states it amounts to over 20% of education spending)
Key line from ED Dept "Dear Colleague" letter: "This guidance does not have the force and effect of law and does not bind the public or create new legal standards." Ed.gov/media/109506

Letter coercively threatens fed. funding based on misstatements of law. States can't just ignore but must resist.
