Confused by this part of the Kadrey opinion, which makes it sound like fair use is akin to a compulsory licensing scheme. Your use could be found not to be a fair use, and you could very much want to pay to keep it going, and the copyright holder could just say "no." I feel like that's not unusual?

I have never understood this sentence in the ReDigi case, a case that holds that resale of a digital music file necessarily involves copying, but...somehow not if you just copied the file onto a thumb drive????? Isn't that also copying??? And in fact even MORE copying than what was at issue????

That curious past tense "was" aside, this sentence at the end of the Anthropic ruling -- I've watched the promise of social media disintegrate into the apparent demise of U.S. democracy. Reading a sentence like this fills me with anxious trepidation about what new transformation awaits us lol

For an interesting juxtaposition, read this paragraph and then reads the way the court freaks out over a research scientist photocopying like seven scientific articles in Texaco (I recently re-read that case, so it's fresh in my mind). I get how you can distinguish. But still.
