Confused by this part of the Kadrey opinion, which makes it sound like fair use is akin to a compulsory licensing scheme. Your use could be found not to be a fair use, and you could very much want to pay to keep it going, and the copyright holder could just say "no." I feel like that's not unusual?
Excerpt reading, "It bears emphasis that when a fair use defense fails, the consequence isn't necessarily that the defendant must stop whatever they were doing. The consequence will often be that the defendant needs to pay the copyright owner for a license that grants them permission to do whatever they were doing. This way, the defendant compensates the copyright owner for the fact that the defendant's conduct will otherwise harm the market for the original work. The defendant will only be forced to stop what they're doing if they're unwilling or unable to pay for the right to do it."

I have never understood this sentence in the ReDigi case, a case that holds that resale of a digital music file necessarily involves copying, but...somehow not if you just copied the file onto a thumb drive????? Isn't that also copying??? And in fact even MORE copying than what was at issue????

That curious past tense "was" aside, this sentence at the end of the Anthropic ruling -- I've watched the promise of social media disintegrate into the apparent demise of U.S. democracy. Reading a sentence like this fills me with anxious trepidation about what new transformation awaits us lol

For an interesting juxtaposition, read this paragraph and then reads the way the court freaks out over a research scientist photocopying like seven scientific articles in Texaco (I recently re-read that case, so it's fresh in my mind). I get how you can distinguish. But still.
"Anthropic purchased millions of print copies to 'build a research library.' It destroyed each print copy while replacing it with a digital copy for use in its library (not for sharing nor sale outside the company). As to these copies, Authors do not complain that Anthropic failed to pay to acquire a library copy. Authors only complain that Anthropic changed each copy's format from print to digital. On the facts here, that format change itself added no new copies, eased storage and enabled searchability, and was not done for purposes trenching upon the copyright owner's rightful interests -- it was transformative."

My least favorite part of the Cariou v. Prince opinion is always this name-dropping paragraph that always comes across to me as "Cariou isn't cool enough for us to care about"
