President Biden said on Thursday that he is commuting the sentences of nearly 1,500 people and pardoning 39 people convicted of nonviolent crimes in a sweeping act of clemency during his final weeks in office.

Most of those being granted clemency had been placed in home confinement during the pandemic. Some Republicans have tried to push legislation that would have forced those people to return to prison.

As the SJC has made clear, the Commonwealth has a duty to investigate and disclose all exculpatory evidence to defendants whose cases may be affected. Prosecutors must now fulfill that duty.
