Yeah that’s what I didn’t get about the bill text. If there was no requirement to report, then at the time the conduct occurred it was lawful. You can’t just declare something unlawful after the fact and then claim damages from it.

The feeling that powerful people can break the law without consequence is what has been driving popular outrage on the left and right since 2008. It can all be traced back to people losing their homes and life savings while everyone on Wall Street responsible just moved on to the next grift.

I’m curious whether her decision was a factor in Senate Dems folding sooner. No judgment from me if so, but it did reinforce the that the shutdown could progress into some adverse judicial rulings as well.
