Maybe so. I just think of Arthrex where they felt like they had to create a whole new scheme of PTO director review to avoid the retroactivity problem (which has cause all kinds of mayhem recently in the patent world).

This is not at all my area of law, but couldn’t the tariffs be held to be void ab initio, meaning the government collected taxes it wasn’t allowed to? I mean, courts are a lot more likely to undo things that look like they just involve moving money around.
