It's certainly true that he believes people who criticize him deserve to die (which is horrifying!). But it's also true that as a narcissist, he believes that everything that happens is somehow about him; the idea that the Reiners' death has nothing to do with him is inconceivable (yes, I know).

It struck me in reading the decision that the question of what constitutes a flight risk is left unclear. OTOH, what does seem clear is that immigrants who are dutifully showing up for scheduled hearings in court should clearly not be considered flight risks, and so should not be subject to arrest

Maybe the first strike would have been a judgment call for the soldiers carrying it out. But the point of the shipwreck example in the DOD manual is that some orders are clearly illegal: it’s not a judgment call anymore at that point.

Leaving all other issues aside, I'm not really sure that hermetically sealing the border (which would have to include tourists coming in and citizens going out) so that we can all go unvaccinated without fear of catching easily preventable diseases is an optimal approach . . .

Nope, not Goldsmith. Just found his article again. But it does cite the 1863 Lieber Code, from the Civil War era, making the wounding or killing of a disabled enemy combatant a crime punishable by death. And the section of the DOD manual barring attacks on persons incapacitated by shipwreck.

It’s also an act that would horrify a lot of Americans who don’t care (wrongly) about fishermen/smugglers being blown out of the water.
