Not only is it very unlikely that those indexation factors will become negative (think about recent downturns and when the BoE base rate was barely over 0%), but index-linked reviews could prop up rents where inflation outstrips true market rents for an asset, locality, or the real estate market

I've since wondered whether the preservation of index-linked rent reviews (albeit theoretically possible of reducing rents on review if the CPI or RPI were to go *down*) will dull the impact of the proposed reforms, albeit still reducing the scope for rents to properly keep pace with market values

In a relatively short judgment the SC found the wording of s10(1) of the Dartmoor Commons Act 1985 "unambiguous". The right to enter Dartmoor for open-air recreation is not caevated by the words "on foot and on horseback" which relate only to the means of access for those pursuits.
