Advocacy Action: Stop SB 164/HB 289, the Abusers' Bill of Rights
This broad and far-reaching bill would create a slippery slope that could lead to fertilized eggs and embryos having the same rights as a living person.

Rep Blanco, an ectopic pregnancy should not be a "complicated issue," that's why #HB289 is a bad bill. #flleg

"It's not about that specific case. The point is, it's about making people have to go through a legal suit for something that they wouldn't have to deal with before. And opening that door when it's a door that I think should rightfully be closed." #HB289 #flleg

"While we can agree, while we can all agree, that people should be able to seek justice if someone's negligence causes the loss of their pregnancy, Florida law already allows this. However, if HB 289 becomes law, embryos would be granted the same rights as living people.
November 18, 2025 at 2:14 PM
"Other states where laws like #HB289 have been enacted, similar provisions have been used by abusers to maintain control over their victims and to harass health care providers who offer care to survivors of abuse. Don't let Florida be next.

One wrote, "If passed, this bill would jeopardize IVF, chemotherapy, and abortion access if the partner, abuser, or even rapist of a pregnant patient is able to sue for the loss or termination of the pregnancy."

Rep Joseph - "So I've heard quite a bit from my constituents on this bill already." #HB289

"If a living, breathing child that was born out of wedlock dies, then the father of that child has less rights and less claim to justice, than someone who fertilized an egg after a one night stand based on the language in. #HB289 - Devon Graham @americanatheists.bsky.social

#HB289 "allows a lawsuit on behalf of a zygote, this increased liability exposure will be devastating to any health care practitioner or hospital that treats pregnant patients and is especially dangerous to OB GYNs who specialize in high-risk pregnancies." - Kara Gross @aclufl.bsky.social #flleg

This is a two-hour committee meeting to hear one bill, but Chair Koster still limited public testimony to only one minute. This type of silencing is unfortunately common in the Capitol. #HB289 #flleg

"Our concern is that this is an attempt to criminalize abortion care at all levels, but especially unsafe and alternate care that people are being forced more and more." - Harrison Lundy @voicesofflorida.bsky.social

#HB289 "makes it more expensive and drives gynecologists out of the state... It makes care less frequent because gynecologists and OB-GYNs are leaving the state, and it is more expensive because their insurance rates are going to skyrocket." - Mark Stevens, ACLU

The amendment fails.
November 18, 2025 at 1:52 PM
Rep Gottlieb has filed an amendment to #HB289 to bring the protections for pregnant people and doctors in line with criminal law.
November 18, 2025 at 1:50 PM
Rep Joseph: "What, if any, physicians were consulted in the drafting of this legislation?"

Rep Greico: "I can't definitively say one way or another. I spoke with a lot of people about this bill, but none that come to mind." #HB289 #flleg
November 18, 2025 at 1:47 PM
So what the bill sponsor is avoiding saying is, yes, if someone helped a pregnant person leave the state to get an abortion after six weeks, it would be legally actionable under #HB289. #flleg
November 18, 2025 at 1:41 PM
"If somebody drove someone to another state to get a lawful abortion, could the driver of the vehicle be sued by the sperm donor under this bill?" Rep Greico answers effectively not if the abortion is legal in Florida.

"I'm asking these questions out of a general desire to understand, in practical law, the effects I want you to understand." - Rep Gottlieb
November 18, 2025 at 1:37 PM
Rep Gottlieb asks. "Would you be able to sue, the estate, which I don't even know how an estate would exist for a fertilized egg but would somebody be able to counter sue the fertilized egg...?" #hb289 #flleg
November 18, 2025 at 1:36 PM
Rep Joseph points out that #HB289 could weaponize the legal system against a pregnant person. " It's kind of like, what do you call that blackmail?"
November 18, 2025 at 1:32 PM
"The funny thing about making laws is that they apply in all instances. So we are we should be concerned with outliers to make sure that we can prevent them." - Rep. Rayner #flleg #hb289

"So if I understand your answer correctly, in the current version of your bill, there are no safeguards to prohibit it."
November 18, 2025 at 1:25 PM
Rep Joseph asks, what's in HB289 to prevent "abusive partners, rapists, one-night stands, et cetera, from bringing frivolous lawsuits?" #flleg
