"Returning to the clear and unmistakable waiver standard better serves the pro-bargaining policy of the Act." — Chairman Lauren McFerran.
December 10, 2024 at 7:56 PM
Today, the Board restored the “clear and unmistakable” waiver standard for evaluating employers’ defenses to claims that they unlawfully changed working conditions of union-represented employees without giving the union notice and opportunity to bargain.

Happy Thanksgiving from the NLRB! 🦃🍂

Today we’re grateful for the hardworking individuals across the country who contribute to our communities every day. As we gather with loved ones, we also celebrate the rights of workers to come together and have a voice in the workplace.

“Today’s decision better protects workers’ freedom to make their own choices in exercising their rights under the Act, while ensuring that employers can convey their views about unionization in a noncoercive manner.”-Chairman McFerran
November 13, 2024 at 6:00 PM
Employers are, however, free to hold meetings expressing their views on unionization so long as workers are informed in advance about the topic of the meeting, that the meeting is voluntary, and that no attendance will be taken.
November 13, 2024 at 5:59 PM
Today, the Board ruled that, going forward, an employer will violate the National Labor Relations Act by requiring employees to attend “captive-audience” meetings in which the employer expresses its views on unionization under threat of discipline or discharge.

While more union election petitions are being filed and the Agency is processing them faster, the NLRB is facing a severe funding crisis.
October 22, 2024 at 2:27 PM
The time from petition to election decreased even as the number of elections increased 27%, from 1,526 in FY 2023 to 1,943 in FY 2024.
October 22, 2024 at 2:26 PM
Of union elections tallied since the 2023 election rule took effect in December, 45% were tallied within 30 days of the filing of the petition, compared to only 13% in FY 2023.

“Additional resources are necessary to enable the Board to expand staffing capacity and ensure that the workers, employers, and unions that rely on our agency benefit from timely resolution of their labor disputes.”
October 15, 2024 at 2:48 PM
As has been the case for the last several years, however, the Board’s case processing achievements were overtaken by a significant jump in case intake, ending FY2024 with 288 pending cases — 46% more than the 197 pending cases at the end of FY 2023.
October 15, 2024 at 2:47 PM
The Board increased its productivity in FY 2024, issuing 259 decisions — a 5% uptick from FY 2023.
October 15, 2024 at 2:46 PM
In FY 2024, the Board received 393 unfair labor practice and representation cases, up 22% from 321 cases last year.
