NLRB Region 32-Oakland secured a Settlement Agreement to resolve allegations in an unfair labor practice charge filed against Mozilla Corporation. Mozilla must make the individual whole by paying a total of $300,000, including backpay, interest, and expenses.

Since 2022, GC Abruzzo’s position has been that employers who subject employees to mandatory captive audience meetings violate labor law.

Recently the Board issued its groundbreaking decision in Amazon Logistics agreeing.

Know Your Workplace rights: Captive Audience Meetings. Under labor law, you have the right to freely decide whether to unionize, including the right to freely decide whether, when, and how to listen to your employer's views on your decision. So, if your employer requires you to attend meetings in which it expresses its views on a union (AKA "a captive audience meeting"), your employer is violating federal law. An employer can ONLY hold a meeting to express its views on a union if it does certain things to make sure you can freely exercise your right not to attend. It must give a reasonable prior notice of the meeting's topic, that it's voluntary with no adverse consequence if you don't attend, and it won't keep meeting attendance records. The National Labor Relations Board is an independent federal agency that protects the rights of private sector employees to join together, with or without a union, to improve their wages and working conditions. Conozca Sus Derechos Laborales: Reuniones de Audiencia Cautiva. Según la ley laboral, usted tiene el derecho a decidir libremente a sindicalizarse, incluyendo el derecho a decidir libremente si desea escuchar las opiniones del empleador acerca de su decisión, cuándo y cómo hacerlo. Por lo tanto, si el empleador le requiere asistir a reuniones en donde se expresen sus opiniones acerca de una unión (también conocida como una “reunión de audiencia cautiva”), el empleador está violando la ley federal. Beyond these remedies, the NLRB General Counsel has obtained remedies for workers who were harmed by unlawful work rules or contract terms.
Know Your Workplace Rights: Remedies. Under the National Labor Relations Act, you are entitled to all of the remedies needed to undo the harm created by unfair labor practices (ULPs) that have affected you. Remedies can include reinstatement and payment of money you lost as a direct or foreseeable result of the ULPs - like costs associated with your home, car/transport, healthcare, or professional license. An employer could also be required to get rid of an unlawful rule or contract term, stop enforcement of it, remove disciplinary actions, and reimburse money you and coworkers lost as a result. If you think you're the victim of an ULP, hold n to your receipts and tell your Board agent about all the financial harms you've suffered. The National Labor Relations Board is an independent federal agency that protects the rights of private sector employees to join together, with or without a union, to improve their wages and working conditions. Conozca Sus Derechos Laborales: Remedios. Bajo la Ley Nacional de Relaciones del Trabajo, usted tiene derecho a todos los remedios necesarios para reparar el daño creado por las prácticas ilícitas de trabajo (ULP por sus siglas en inglés) que le han afectado. Los remedios pueden incluir la reinstalación y el pago del dinero que usted haya perdido como consecuencia directa o previsible de las ULP—tales como los gastos relacionados con su vivienda, coche/transporte, asistencia médica o licencia profesional. In sum, the NLRB’s field offices received a total of 24,571 cases, the highest total case intake since FY 2011.

However, due to resource constraints, the NLRB has 62% fewer field staff to process cases than it did in FY 2011.
