The judge had the authority to order a fair map b/c the people of Utah voted for a constitutional amendment requiring it. The GOP leg ignored it, leading to the suit.
Partisan gerrymanders are not illegal under Federal law. It depends on the state. And increasingly, the makeup of the state’s SC.
