The regular season does matter, as the ND win is what's keeping Miami in the picture. Swap out the ND win for, say, an FIU drubbing, and keep everything else the same, Miami wouldn't even be in the conversation.

The utter disrespect shown to the work of the district court judges is just shocking. In the normal course, overturning the findings of fact is so outside the norm appellate courts devote copious analysis and justification as to why. Apparently not on the shadow docket.

It's not. The Court stated that the District Court didn't do the proper analysis for a finding of facial violation of the First Amendment, as opposed to as applied, and remanded for further proceedings. Even the dissent agreed with this.

I believe 1983 only applies to state governments. The only federal equivalent is the Bivens case, which has been so pared down that the joke is you get relief only if you are Bivens.
