It should be no surprise but still alarming the shift from "AI/AV will be so much better than human drivers" to "well, it will be better but also we shouldn't judge too harshly [or sue] when it isn't".

We've known for years this is something we need transportation law scholars on the forefront of.

Such fears are entirely reasonable, but NHTSA ignores then. The agency holds no blind zone tests of any kind.
