Awardees receive the credits annually for 10 years, so $1.36 million in credits is actually worth closer to $13.6 million in equity. The IRS allocates a limited number of this type of LIHTC to states every year; they are among the biggest source of federal affordable housing funding in the nation 4/

The forfeiture is due in part to Binitie's failure to use some of the credits he was awarded in 2020. DHCD used a "credit swap" to take back $1.2M of his unused credits and gave him $1.36M in 2023 credits. 3/

More misleading/incorrect information from MPD: Smith on Wed. said MPD prepared a statement about the shooting on Oct 18.

They sent it to the Post this week. It says MPD was called to the scene because of the shooting, but does not say MPD officers WERE PATROLLING WITH THE FED WHO FIRED THE SHOTS.

MPD also provided me with another public incident report, called a "251," that says "HSI member discharged their service pistol at a subject of force at the listed location."

The fact remains that another officer testified in court that he was instructed to withhold that information.

Another update here: An MPD spokesperson says the department does not intend to release the body camera footage any time soon. The footage is part of the internal affairs investigation and will be withheld from FOIA requests until that is complete (they usually take a long time).

Notable that the Superior Court judge found no probable cause to support charging Phillip Brown with fleeing from law enforcement, as the DHS statement continues to allege, and she dismissed the case. Brown also was unarmed (there was no mention of a firearm recovered from the vehicle). ...

A DHS spokesperson just sent me the below statement. This is the first time I've seen any law enforcement entity provide an explanation for the HSI agent's decision to fire his service weapon—essentially, he feared for his life and fired "defensive shots."

Another oddity: MPD did not provide the body camera footage of the incident—not even to the U.S. Attorney’s Office, which must decide if there’s sufficient evidence to bring charges.

The footage still has not been released to Brown’s lawyers; prosecutors told her it’s “locked down.”

The driver, Phillip Brown, wasn't hit by any bullets, but one ripped through the collar of his jacket, and two others pierced his passenger seat.

He was charged with fleeing from law enforcement and spent four days in jail before a judge dismissed the case for lack of probable cause.

King was testifying on behalf of his friend, Officer Peter McCauley, who led a VA state trooper on a high speed chase in his Tesla, reaching up to 119 mph. MPD wants to fire McCauley. King asked them to show leniency. "The same grace we show civilians, we gotta give to ourselves."

Asked how he would feel about getting a ticket from a cop who was convicted of reckless driving, King basically shrugged it off: "But it’s the same situation if an officer got a DUI or used excessive force. I’m not going to pretend the department is without sin, or I’m without sin."
