The issue might not so much about size of the armed forces at "peacetime". But exceeding these limits during build-up to counter a direct threat might serve as a cheap excuse to blame Ukrain of a treaty violation.

NATO should have closed Ukrainian airspace west of the Dniepro after the liberation of Cherson in 2022. And the sky over the western black sea as well.
