Civil Misc. Action No. 25-0170 (CKK) ORDER (December 10, 2025) In response to this Court's [10] Order dated December 6, 2025, Attorney Robert K. McBride sent an email to this Court's Chambers at approximately 11 :58 a.m. ET on December 8, 2025, attaching a document certifying the Government's compliance with the Court's [10] Order, along with proposed Notices of Appearance for himself and Attorneys Todd W. Blanche and Lindsey Halligan.1 Petitioner Daniel Richman's counsel received a copy of these attachments by email soon thereafter. Attorney McBride explained in the body of his email to Chambers that counsel were "in the process of obtaining" electronic filing privileges in this District. As a general matter, providing documents by email is not a substitute for filing them on the docket, and doing so does not make them part of the official record of the case. To date, the Government's certification of compliance with this Court's [10] Order has not been filed on the docket, and Attorneys Blanche, Halligan, and McBride have not yet formally entered their appearances.

Reminder for anyone who doesn't know (or has forgotten) what that is.
Under the Younger abstention doctrine, federal courts are prohibited from interfering with ongoing state criminal proceedings absent extraordinary or special circumstances. Younger v. Harris, 401 U.S. 37, 43 (1971); Phelps v. Hamilton, 122 F.3d 885, 889 (10th Cir. 1997). Abstention is appropriate under Younger if three conditions exist: “(1) an ongoing state judicial . . . proceeding, (2) the presence of an important state interest, and (3) an adequate opportunity to raise federal claims in the state proceeding.” Travelers Cas. Ins. Co. of Am. v. A-Quality Auto Sales, Inc., 98 F.4th 1307, 1317 (10th Cir. 2024) (quotation omitted). “Younger abstention is jurisdictional” and thus must be addressed “at the outset.” D.L. v. On May 5, 2025, the Court issued an Order to Show Cause as to why the Application should not be dismissed as a mixed petition. [#47] On June 4, 2025, Ms. Peters filed her response to the Order to Show Cause. [#50] After reviewing the pertinent filings, on July 22, 2025, the Court held a hearing on the issues of exhaustion of state remedies and Younger abstention. [## 58, 60] At that hearing, counsel for Ms. Peters indicated her intention to only proceed with Claim 1, the First Amendment claim, and to dismiss the remaining claims. [#60 at 9-12, 34, 38] And on July 25, 2025, Ms. Peters, through her counsel, filed a Notice of Partial Dismissal of Claims, which dismissed Claims 2 and 3 in her Section 2254 Application and affirmed that “the sole remaining claim made in Ms. Peters’ Application for a Writ of Habeas Corpus is Claim 1 . . . seeking her release on bond pending her appeal due to the violation of her First Amendment rights.” [#59]

Interesting. Seems that Colorado initially failed to raise Younger abstention.

Peters not unreasonably tried to argue that the state had waived it.

Court says nope, we should address that issue sua sponte.
Because Younger is jurisdictional and non-discretionary, the Court rejects Ms. Peters’ argument that Respondents waived their opportunity to raise Younger abstention. A Court “may raise the issue of abstention sua sponte.” D.A. Osguthorpe Family Partnership v. ASC Utah, Inc., 705 F.3d 1223, 1231 (10th Cir. 2013). Indeed, because Younger is jurisdictional, “[w]hen all of the elements mandating abstention clearly exist in the record, courts may, and should, address application of the Younger abstention doctrine sua sponte.” Nationwide Mut. Ins. Co. v. C.R. Gurule, Inc., 148 F. Supp. 3d 1206, 1216 (D.N.M. 2015) (emphasis added). Here, consistent with these principles, the Court noted potential jurisdictional defects and ordered the parties to address jurisdictional issues, including the Younger abstention doctrine. [#60 at 33-35] And consistent with that Order, Ms. Peters filed a response that addressed Younger and she has thus had an opportunity to be heard on the issue. [#65 at 17-20]

Attorney General Pamela Bondi @AGPamBondi Following the flawed Third Circuit decision disqualifying Alina Habba from performing her duties in the U.S. Attorney's office for the District of New Jersey, I am saddened to accept Alina's resignation. The court's ruling has made it untenable for her to effectively run her office, with politicized judges pausing trials designed to bring violent criminals to justice. These judges should not be able to countermand the President's choice of attorneys entrusted with carrying out the executive branch's core responsibility of prosecuting crime.

It's not self-executing. The pardon attorney needs to actually write out a pardon certificate and stamp it.

Trump's inauguration day executive order, as I understand it, doesn't pardon the J6 pipe bomber automatically.

For one, it speaks of "individuals convicted", which is retrospective.

Secondly, if I've understood, the EO itself is not a pardon, so much as an order to the DOJ and BOP.
