Even if the price concessions are not phantom discounts, as is so often the case, the threat to liberty from concentrating taxing authority in the executive surely outweighs them.

It should trouble every democrat and republican — both lower-case — that the federal government is such an incompetent price negotiator, it can extract concessions from drug companies only if the president asserts unilateral authority to tax whomever he likes.

For lack of a better term, I use (and recommend using) Obamacare to describe just about everything that the federal government has done under the rubric of the ACA since 2011.

Calling what the federal government is now operating “the ACA” sanitizes those sweeping violations of the Constitution and democratic norms by suggesting those changes passed Congress.

The ACA didn't allow the *old* premium subsidies, fer cryin out loud.

Since at least 2011, the executive & judicial branches amended the ACA in so many ways that never did or would pass Congress, it's flatly inaccurate to say that what the government is currently operating is the ACA.

But it is even worse than inaccurate.
