Most of these protections come from Reg X, under the Real Estate Settlement Procedures Act (RESPA), from 1975!
They exist so servicers treat you fairly. They know these rules, but mistakes still happen all the time. Make sure that they know that you know.

Your escrow pays taxes & insurance.
Your servicer must:
- Send you an annual escrow statement
- Explain how your escrow balance was calculated
Changes in tax/ins can increase your payment, and mistakes do happen—know your numbers!

Did you know you can send a written request to your mortgage servicer and they MUST respond? It’s called a “Request for Information.” They have 30 business days to respond accurately.
You’re not powerless. Use your rights.

Dual tracking = starting foreclosure while also reviewing you for assistance.
🚫 It’s restricted by law.
Your servicer can’t foreclose while your help request is active.
This rule protects borrowers from losing their homes unfairly.

If you’re eligible for assistance, your servicer must offer you a solution—not just say no. That could include:
✔️ Forbearance
✔️ Loan modification
✔️ Repayment plan
You have options. Don’t assume you’re out of luck.

You don’t need to wait until you're behind to reach out. If you’re worried about making payments, you can request hardship options in advance.
Being proactive helps protect your home *and* your credit.

If you ask your mortgage servicer for help b/c you’re having trouble making your pmt (aka "loss mitigation" in the biz), they must respond:
* W/in 5 business days, they must acknowledge you
* W/in 30 days, they must give a decision
It’s the law

If you’re facing hardship, your mortgage servicer *must* have a process to help.
Regulations require:
1. Acknowledge your request
2. Communicate clearly
3. Evaluate options like forbearance or modification
More to come.

Federal rules say your mortgage servicer can’t report your payment as late for 60 days after a transfer, even if it IS late.
Why? Because mistakes happen during hand-offs. The law protects you from getting unfairly dinged.

You will receive:
- A “goodbye” letter from the old servicer
- A “hello” letter from the new 1
It's required by law. Also w/in 60 days of a transfer, they can’t report you late to the credit agencies, so relax. The law's on your side.
