Isn’t the rebuttal to that that if DOJ wants to investigate Comey they can get a fresh warrant?

Why does footnote 21 not say that?

It does belie the notion that there is an emergency going on in Chicago, though, doesn’t it?

Maybe you could get on the news if there is another pandemic or something.

I agree. But Roberts gives POTUS the power and freedom of action to subvert Congress, which this POTUS has done.
October 26, 2025 at 11:46 AM
Isn't that basically inevitable? Roberts emphasizes the need for POTUS to have freedom of action, decisiveness, etc. But Congress is basically the most unwieldy committee ever created - how can it possibly hope to keep a John Roberts style POTUS in check?

Today's show on this was great - one thing you didn't mention is that Nachmanoff has already said that he would not hear the Halligan appointment motion. Instead it will be heard by a judge outside of EDVA who will be selected by the Chief Judge of the 4th circuit.

Maybe Kavanaugh would have had more sympathy for the plaintiffs if ICE had accosted them while they were playing a pickup basketball game (something Kavanaugh can imagine doing himself) rather than while they were looking for low wage work (something he can't)..

Are the words themselves the problem or are the words just symptoms of deeper problems? To me the words are generally used less by Democratic politicans themselves and used more by the interest groups that the politicans are seen as beholden to, and that the GOP is very effective at tying Dems to.

This is like the "you created Trump by being mean to Mitt Romney" thing.
August 13, 2025 at 5:51 PM
I think your point rings true, but I struggle to see how we get from here to having the political power to undertake a project of renewal, whether partisan or not. I guess the most likely path is a new New Deal coalition? But that was an odd collab between northern FDR Dems and southern racist Dems.

Biden would have lost the election if he embraced court expansion.
