Back to the CBP website to check, which points us to a presidential memo and to "Annex II", which I understand to be Annex II to Executive Order 14257, here: www.whitehouse.gov/wp-content/u... - so that's the same list of exempt HS codes as in the HTS.

There are also other exemptions which currently apply to books. HTS 9903.01.32 sends you back up to look at the notes for this chapter, which list a bunch of chapter codes as exempt from additional duties, including our friend 4901 where books live. We've imported books under this code previously.

Heading over to the Customs & Border Patrol website for a second to look at their info on these emergency powers, there's a useful definition of what might count as informational materials - including books and printed materials, which is what "Chapter 49" includes here. www.cbp.gov/trade/progra...

And there, under 9903, we can find temporary codes for things that are defined as informational materials. There are specific codes for products that originate in Mexico, Canada, China/Hong Kong; it's 9903.01.31 for everything else.

This is relevant because Trump's trying to use emergency powers to make these changes - he's declaring several national emergencies, under IEEPA - and so his power is bound by this section of the code. Here's what it says. (Janky screenshot, sorry, the US code website is down right now lol)
