Two core findings:
• 1) Contra theory, EU member states influence courts MORE when they lack formal override power - ECJ responds more to legal arguments (-0.174) than credible threats (+0.048).

• 2) Referring court hierarchy fundamentally shapes ECJ behavior - it’s not just background noise.

I’m sorry but who’s gonna strike it down ? SCOTUS? Law only matters insofar courts, legal academics, prosecutors are willing to enforce it.
