the government's argument here is "you have to sue us individually if we violate your rights" - an assertion that is untrue, to be sure. but I really hope there are some lawyers out there willing to take them up on it. firms should take on mass pro bono cases of individuals harmed by ICE/CBP

Before even reading it, I think this is a structurally poor appellate brief. But the real admission here is the assertion that the injunction is "unworkable." The injunction recites the government's own policies and demands compliance with them. Impossible to say such a thing is unworkable.

It can often be very difficult for judges and plaintiffs to establish that a defendant has harmed the plaintiff intentionally, or that a public official acted with knowing disregard for the law, etc.

This makes it a slam dunk! It is an admission! A brag!
