Juror asks whether and how other nations' leaders named in the indictment bear responsibility for ecocide. The witness points to Francesca Albanese's report, which revealed "Third States’ direct support, material aid, diplomatic protection and, in some cases, active participation" in the genocide.

Some jarring stats: The expert witness tells the tribunal, citing UNEP data, that 97% of trees, 95% of shrubland, and more than 80% of annual crops have been destroyed in Gaza.

The expert argues that Israel used environmental destruction to intimidate and coerce Gazans and to undermine their future; the extent of the damage was not "militarily necessary." "Such widespread, long-term, and severe damage constitutes ecocide."

The expert tells us that Israel had knowledge and intent to cause damage to Gaza's environment on this scale. He references, among others, Gallant's October 2023 order to impose a "complete siege" on the enclave. Exhibits show before and after satellite images; green spaces are now barren.

There's an expert witness speaking about ecocide now. Some nations criminalize ecocide, and the Rome Statute recognizes an attack committed with the knowledge that it will cause “widespread, long-term and severe damage to the natural environment” as a crime. But the bar for prosecuting it is high.

The witness statement ends, and Lead Prosecutor Jan Fermon tells the jurors that the destruction of Gaza's port is "obviously a war crime; it’s a civilian target." He argues it's part of a "genocidal plan," to not allow any sustenance into the enclave, "not even the fish from the sea."

The witness tells us that Israeli forces have targeted and killed dozens of fishers who were trying to access the sea. "There is a deliberate strategy to create famine, to prevent fishermen from feeding our people.”

The Port of Gaza was attacked early on, in October 2023. The witness testifies that 95% of Gaza's fishing boats are too damaged to use, along with vital infrastructure like shipbuilding yards and storage. "700 fishing boats now lie sunken in the harbor basin, destroyed by Israeli aircraft."

Next, we'll hear from a fisherman in Gaza. He shares that fishing is vital to Gaza's food production and economy; the sector employed some 6,000 people, and as many as 60,000 had some connection to it before the genocide.

A juror asks the witness what happened to the aid the flotilla was carrying toward Gaza, including baby formula and medicines. "It was kidnapped."

"Even with all the attention we had, and all the support we had, they could do these things to us"; the witness tells the court it is hard to imagine how Israeli forces treat Palestinian prisoners.

On the stand now: A member of the Global Sumud Flotilla, speaking about their experience after Israeli forces intercepted their ship in international waters and abducted its crew. The witness tells us the crew was held in a cramped cell, denied water and medicines, and not allowed to sleep.
