There is also the issue that the IP holders of the actual game could file a cease and desist as well. Which more and more publishers have been doing.

Yeah itchio admins unfortunately err on the side of caution with this minor depiction issue. Not saying what itch does is right, but they can be sued in court for allowing actual minor depiction in inappropriate manners.

If I got a notice from itch, I would get an email unless I explicitly unchecked the box for receiving communication from itch. So this notice wasn't there at the removal?

There are users who are saying both sides. Some can download, others cannot. Hmmm...
