Furthermore the bad part of what they did (requiring users to price at the suggested rate) is different from what we’re trying to ban (suggesting a rate). It takes only moderate intelligence to understand the difference between these things.

I don’t know why you’re claiming I’m pro-price fixing, but I’m not. My stance is that price fixing it bad, it is possible (though not guaranteed) that RealPage was doing it, but *even if they are* their pricing power in Portland is too low for it to make more than about a 5% difference in rents.

The important point here is your words: “a tiny marginal portion of that profit.”

This law will have very limited impact because it has a tiny marginal effect.

We can argue whether or not it’s worth the costs of the inevitable lawsuit, but AS YOU SAID, it will have a tiny marginal impact on rent.

Specifically, I think Mitch should have addressed with Dan privately, and Dan should have apologized publicly. And if Dan refused to do this, *then* it would be appropriate for Mitch to call it out online. This is not my understanding of how the sequence of events unfolded, but I may be wrong.
