Your 1A rights can be violated without you being arrested.

OU is a state school so a government actor. If the grade had been based on the religious statements, that would have been a violation of 1A.

The essay was shit which is why it got the grade it did - not because of the religious commentary.

There is no such thing as “broadcast defamation” - there is only defamation.

And the “original” post you cited to cited a post about a U.S. politician and was very clearly in response to how the reporter handled the comments by the politician.

There is not really a way to prevent mis- or disinformation.

You can combat its success through education, awareness, and the spreading of correct information - but even in dictatorships where the press is strictly controlled, things the government deems as “incorrect” get spread around.

The issue I have with Irish defamation law is that it often leads to retractions even for factual statements or statements of opinion - such as the publication that had to issue a retraction and pay a penalty for correctly identifying a politician in a manner the politician didn’t like.
