It's nonsense.

There's extensive evidence that rioters knew they were breaking the law.

Here's one of the rioters making a call, knowing that she might need to be bailed out of jail.

As violence against police escalated on the west front of the Capitol, some of the rioters appeared to take pleasure and even laugh.
