(8) Among greatest infirmities - legal, moral, policy - is federalizing the Guard to police protest activity when the situation was under control (including with CA Guard if Newsom wanted to use them).

In context, this looks not like "escalating to de-escalate," but escalating to escalate further.

It does not tell you under what authority.

My best guess what the White House is thinking: inherent Article II “protective power” (which has never been tested in court).

The presidential memorandum never mentions Los Angeles or California. It’s a blank check for mobilizing National Guard and active duty troops to deploy anywhere to protect federal personnel or functions wherever protests “are occurring or are likely to occur.”

(3) The Memo authorizes the military forces onto the ground even WITHOUT the existence of disruption to federal law, but instead as PREEMPTIVE action.

A far cry from Justice Department’s long-standing view that the military should be deployed in such domestic situations as a “last resort.”

Note the “or”!

That means First Amendment non-violent protests. Not violence. Not riots. Protests.

Such a claim would make authoritarians blush.

(1) The Memo essentially labels what were sporadic acts, among otherwise generally peaceful protests in LA, a “rebellion.”

That may be one of the greatest weaknesses that should not survive contact with the courts.

This matters. Not because I think Trump is capable of mercy or empathy towards these vulnerable groups. But because it is a public act of defiance.

Contrast that with all these other powerful people in this country signaling nothing but appeasement and obedience.

The new "sex and gender" executive order does nothing but make trans people's lives more difficult than they already are. Trans prisoners will be raped more, trans federal employees will be discriminated against more, and trans travelers will be subject to unneeded hassle.
