In fact, earlier in the opinion Roberts says we can’t subject medical diagnoses and treatments to heightened scrutiny because they are often “uniquely bound up in sex.” I think that shows that what is going on is just an ad hoc exception for the medical treatment context.

Doesn’t example from Medina which has the nursing facility as the grammatical subject of the sentence show that the 8th Cir was wrong to say the VRA was not rights creating just because the state is the grammatical subject of Section 2?
