The Trump administration says it's "compliant" with an order to provide phone services so detainees may communicate with counsel.

Plaintiffs "continue to have concerns."

Good morning. Federal prosecutors have moved to dismiss another case stemming from protests outside Broadview's ICE facility — this time involving an alleged attack on U.S. Border Patrol commander Greg Bovino.

The feds recently sought extra time to indict in this case.

UPDATE: A new court filing tonight reveals that U.S. Border Patrol commander Greg Bovino's deposition in Chicago is not finished yet.

It's expected to continue Tuesday.

#BREAKING The 7th U.S. Circuit Court of Appeals sides against U.S. District Judge Sara Ellis, who had asked Border Patrol chief Greg Bovino to appear in her Chicago courtroom on a daily basis.

The appeals court finds that her order "infringes on the separation of powers."

Plaintiffs in the lawsuit before Judge Sara Ellis in Chicago have filed their response to the 7th Circuit, over whether Border Patrol Cmdr. Greg Bovino should have to appear in court daily.

They note, as Ellis did, that "Bovino himself has stated publicly" that it "poses no obstacle to his work."

JUST IN: The U.S. Supreme Court wants to hear more in the Illinois National Guard case.

Specifically, it wants to know "whether the term 'regular forces' refers to the regular forces of the United States military" and how that affects the law in play.

NEW: On the eve of Greg Bovino's court-ordered appearance before Judge Sara Ellis, lawyers in the case ask her to fully bar the feds from using tear gas until she rules on a preliminary injunction.

"Something must be done. Defendants are plainly in contempt, and sanctions are warranted."

In another filing tonight in the case before Judge Sara Ellis in Chicago, plaintiffs' attorneys say depositions are set to begin Wednesday (Greg Bovino is among those to be deposed).

But the feds are seeking an order that would make those depos "inaccessible to the public," they say.
