The 5th Circuit had a present for FinCEN and US Treasury: a stay of the ED Tex nation-wide injunction against the Corporate Transparency Act. Reporting requirements are effective again, though FinCEN has given a short extension to January 13 for most.

5th Cir decision striking Nasdaq's diversity disclosure rule takes a narrow view of Exchange Act. It could have far-reaching implications for SRO rulemaking. At a minimum, it’s the Fifth Circuit flexing its muscles to redirect the SEC under 𝘓𝘰𝘰𝘱𝘦𝘳 𝘉𝘳𝘪𝘨𝘩𝘵.

President-elect Donald Trump will nominate Paul Atkins to chair the SEC. A Republican controlled Senate will easily confirm him absent new information: Atkins previously served as an SEC commissioner from 2002 to 2008 under President George W. Bush.

FINRA just lost its ability to expel members, and probably to bar representatives, and it’s probably a bigger deal than people seem to be letting on.
