(4) Engage in what Daniel Kono called ‘optimal obfuscation’. This would imply leaving the reduced tariffs (and the FTAs) in place, but re-erecting non-tariff barriers such as stopping certification, slow-rolling the processing of US goods in customs, …. ) which are more difficult to monitor. (5/6)

(3) retaliate and forget the trade agreement existed. This can act as a starting point for negotiations. For monist systems where international agreements typically supersede domestic laws this may create a legal challenge. (4/6)

(2) the partner can terminate the agreement. FTA’s do foresee a termination procedure. If this is followed, it has a delayed impact (often 180 days). This might be preferred over an immediate termination to signal an adherence to the rule-based order and limit the shock to businesses, (3/6)

(1) Trading partners can file a complaint through the dispute settlement mechanism embedded in the FTA. A complaint at the WTO is also possible, but either option feels like reminding a raged berserker there are rules to economic warcraft. (2/6)

"I kept lectures and discussions about the Middle East to a minimum because the student response had the potential to trigger more heat than light." Love the sentence. Also made me wonder whether our uneasiness to cover the issue in class has not given room for the extreme polarisation we see now.
