What does it even mean to destroy diversity, equity, or inclusion?
Confusion began, at least at the public level, that night, when Governor Youngkin went onto Fox News to crow that “DEI is dead” at UVA. That was an exaggeration of the Board’s resolution. It was also a little hard to decipher, as it’s not clear even today what it means to kill DEI, and the Governor didn’t go much beyond the soundbite. For example, did it mean that we could no longer try to recruit qualified first-generation students from rural parts of Virginia, or offer financial aid, or even serve matzah in the dining halls during Passover, because each of those efforts would be advancing diversity, equity, and/or inclusion? Regardless, the Governor’s theatrics created a false impression in the public that the Board had resolved do something radical and sweeping as opposed to something tempered.

As stated in open court, this Court recently addressed the issue of whether Section 1226 or Section 1225 governs foreign nationals who are similarly situated to the foreign nationals who have been arrested in connection with Operation Midway Blitz. In that decision, this Court determined that the foreign nationals in question were subject to arrest and detention under Section 1226, and not under Section 1225. See Patel v. Crowley, No. 25-cv-11180, 2025 WL 2996787 (N.D.Ill. Oct. 24, 2025). The Court's holding to this effect is consistent with the decisions of every one of the 21 district judges in this District who have ruled on this issue as well as with the decisions of well over 100 other district judges from around the country. See, e.g., Berto Mendez v. Noem, No. 2:25-CV-02062-RFB-MDC, 2025 WL 3124285, at *2 (D.Nev. Trump on Truth Social: The U.S. Supreme Court was given the wrong numbers. The “unwind” in the event of a negative decision on Tariffs, would be, including investments made, to be made, and return of funds, in excess of 3 Trillion Dollars. It would not be possible to ever make up for that kind of a “drubbing.” That would truly become an insurmountable National Security Event, and devastating to the future of our Country - Possibly non-sustainable!

I immediately assumed that Justice Jackson ruled after having communicated with the other justices about what they wanted to do, even if she didn't officially refer the application to the full Court for resolution by per curiam order.
In a world in which Justice Jackson either knew or suspected that at least five of the justices would grant temporary relief to the Trump administration if she didn’t, the way she structured the stay means that she was able to try to control the timing of the Supreme Court’s (forthcoming) review—and to create pressure for it to happen faster than it otherwise might have. In other words, it’s a compromise—one with which not everyone will agree, but which strikes me as eminently defensible under these unique (and, let’s be clear, maddening and entirely f-ing avoidable) circumstances.

We apologize for asking the Court to act so quickly, but we were putting the finishing touches on our Rudyard Kipling references for a while.
The district court focused on the fact that Congress gave USDA certain power to reallocate a portion of its appropriations across different programs. But from that premise, the court held that it was arbitrary and capricious under the Administrative Procedure Act (APA) for USDA to refuse to use this authority to drain $4 billion from Child Nutrition Programs to fully (rather than partially) fund November SNAP payments. That is as wrong as it sounds. As USDA explained, pulling billions of dollars from the Child Nutrition Programs would jeopardize those programs’ ability to fully operate this year—putting at risk critical food-assistance initiatives relied upon by millions of children every day, and raiding a program that Congress did fund to instead extend one that Congress has not funded. The district court discounted this concern by speculating that Congress would surely later appropriate money to pay back any multi-billion-dollar transfer from Child Nutrition Programs. But it obviously was not unlawful for the agency to see things differently—and refuse to starve Peter to feed Paul, by gambling school lunches tomorrow in exchange for more SNAP money today. Indeed, that sort of hard tradeoff is precisely the sort of decision that Congress committed to agency discretion and placed beyond the reach of judges

The city of Bee Cave is back to the drawing board for its new public library building after voters approved a proposition to build the library but voted against a proposition that would fund it. Proposition A authorizes building a new 18,500-square-foot library on a piece of land near Hill Country Indoor, and was approved with 56.61% of the vote, according to unofficial results from Travis County released at 12:02 a.m. on Nov. 5. Proposition B would have authorized the city to issue bonds and levy a tax to fund the $19.98 million project, but was ultimately voted against by 54.66% of voters.

It turns out everyone at today's Supreme Court argument is excited about the Bake Off final.
JUSTICE KAVANAUGH: Mr. Katyal referred to common sense several times. And I want to pick up on Justice Barrett's question because your interpretation of the statute, as she pointed out, would allow the President to shut down all trade with every other country in the world or to impose some significant quota on imports from every other country in the world, but would not allow a 1 percent tariff. And that leaves, in the government's words, in its brief, an odd donut hole in the statute. Why would a rational Congress say: Yeah, we're going to give the President the power to shut down trade. I mean, think about the effects. But you're admitting that power's in there. MR. GUTMAN: Yeah. JUSTICE KAVANAUGH: But -- but can't do a 1 percent tariff. That doesn't seem -- but I want to get your answer -- to have a lot of common sense behind it. MR. GUTMAN: I think it absolutely does because it's a fundamentally different power. In 1918, Eugene Debs was convicted of sedition for publicly opposing American participation in World War I. Debs gave a statement upon being convicted that was, among other things, hopeful that we would make a more just society. Last night, Mamdani said those words from his victory stage.
Your Honor, I ask no mercy and I plead for no immunity. I realize that finally the right must prevail. I never so clearly comprehended as now the great struggle between the powers of greed and exploitation on the one hand and upon the other the rising hosts of industrial freedom and social justice. I can see the dawn of the better day for humanity. The people are awakening. In due time they will and must come to their own.
