The "dumb pipe" analysis seems particularly tortured. My paraphrase: telephone service is a dumb pipe and therefore Title II, but while broadband service is a pipe, and is dumb, the pipe contains... bits.

Because they decide Title II classification is inconsistent with the plain language of the statute, they don't do any Major Questions analysis.

The place I used to stay by my dad on the upper west side (NY) had rooms just like that. It's even more of an adventure with two people.
