Given where discussions were at the time (in particular with regard to the international governance of nuclear weapons) Brodie's assumptions on Congress having a say are not so outlandish in that context.

Somewhat simplistically put: the whole presidential authority stuff after 1945 goes back to Truman's conclusion that only the President rather than the military should have the authority to launch (vs especially Nagasaki). Some great sources on this on the Nat Sec Archive website I think.

The problem is: they need to act as such because the system is set up that way. It's interesting that there hasn't been a discussion about their charitable status in light of this.
